Terms of Service

This tool provides estimates and does not constitute financial advice.

These Terms of Service ("Terms") form a legally binding agreement between you and StreetGauge ("StreetGauge," "we," "us," or "our") regarding your access to and use of our website, web application, browser extension, waitlist, email communications, and related services, content, functionality, and technology (collectively, the "Services").

By accessing or using the Services, clicking to accept these Terms, creating an account, or otherwise using any part of the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

1. Eligibility and Authority

You represent and warrant that you are at least the age of majority in your jurisdiction and have the full right, power, and authority to enter into these Terms. If you are using the Services on behalf of a company, fund, partnership, or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms, in which case "you" and "your" refer to both you and that entity.

2. The Services

StreetGauge is a software product designed to support rental-property screening and analysis. The Services may include, without limitation:

  • importing or manually entering property and listing information;
  • creating, saving, editing, and comparing deal analyses;
  • scenario modeling, assumptions management, and pipeline workflows;
  • browser-extension functionality for extracting listing information from supported pages;
  • settings synchronization between the web app and extension; and
  • data export, comparison, and other productivity features.

The Services are intended to assist users in organizing and evaluating information relevant to real estate opportunities. The Services do not act as a broker, lender, appraiser, investment adviser, attorney, accountant, or fiduciary.

3. Account Registration and Security

To access some features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep that information updated.

You are responsible for all activities that occur under your account and for maintaining the confidentiality and security of your login credentials, devices, and sessions. You must promptly notify us if you believe your account has been compromised or used without authorization.

We may suspend, restrict, or terminate access to your account if we reasonably believe that you have violated these Terms, created risk or potential legal exposure for StreetGauge or others, or otherwise used the Services in a manner that is unlawful, abusive, fraudulent, technically harmful, or inconsistent with the intended operation of the Services.

4. License to Use the Services

Subject to your compliance with these Terms, StreetGauge grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Services for your internal, lawful business or personal evaluation of real estate opportunities.

This license does not grant you any ownership rights in the Services or any right to copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, create derivative works from, or otherwise exploit the Services except to the limited extent expressly permitted by applicable law notwithstanding this restriction.

5. User Data and Content

As between you and StreetGauge, you retain ownership of the deal data, notes, assumptions, settings, uploaded inputs, and other materials you submit to or generate within the Services ("User Data"), subject to the rights you grant below and any rights of third parties in source materials or underlying data.

You grant StreetGauge a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, modify, adapt, and otherwise use User Data solely as necessary to operate, maintain, secure, improve, and provide the Services, including to support product features you request, such as analysis, synchronization, enrichment, import, export, diagnostics, and backup or recovery operations.

You are solely responsible for the legality, accuracy, quality, and appropriateness of User Data and for ensuring that you have all necessary rights, permissions, and lawful bases to submit, use, store, and instruct us to process that User Data in connection with the Services.

6. Browser Extension and Third-Party Source Data

Certain features of the Services rely on our browser extension and on information available through third-party websites, listing pages, or other external sources. You acknowledge and agree that:

  • the extension may access page content in supported tabs in order to perform the workflow you initiate;
  • the availability, structure, and accuracy of third-party pages or source data may change at any time without notice;
  • StreetGauge is not affiliated with, endorsed by, or responsible for third-party listing platforms, data sources, browser vendors, or external websites unless expressly stated otherwise; and
  • your use of third-party websites or data sources in connection with the Services remains subject to the terms, policies, and restrictions of those third parties.

You may not use the Services, including the extension, in a manner that violates applicable law, infringes third-party rights, bypasses contractual or technical restrictions, or misuses third-party content or systems.

7. Acceptable Use Restrictions

You agree that you will not, and will not permit any third party to:

  • use the Services for any unlawful, infringing, fraudulent, deceptive, or abusive purpose;
  • resell, sublicense, lease, distribute, or otherwise commercially exploit the Services except as expressly authorized by StreetGauge in writing;
  • attempt to gain unauthorized access to accounts, data, systems, or networks related to the Services;
  • interfere with or disrupt the integrity, performance, or security of the Services;
  • circumvent or attempt to circumvent rate limits, access controls, security protections, or technical restrictions;
  • use bots, scrapers, crawlers, or automated methods against the Services themselves except as expressly permitted by us;
  • introduce malware, malicious code, or harmful content into the Services;
  • remove, obscure, or alter proprietary notices or branding contained in the Services;
  • use the Services to develop or train a competing product using non-public aspects of the Services; or
  • use the Services in a manner that could reasonably harm StreetGauge, other users, or third parties.

8. Product Changes, Availability, and Beta Features

We may modify, update, suspend, discontinue, or impose limits on any part of the Services at any time, with or without notice, including features, integrations, workflows, storage practices, or availability.

Some features may be offered on a beta, trial, early-access, or preview basis. Such features may be incomplete, modified, suspended, or withdrawn at any time and may be subject to additional terms or feature-specific limitations.

9. Fees, Trials, and Paid Features

Certain features of the Services may be offered on a paid basis now or in the future. If we offer paid plans, subscriptions, trials, or promotional pricing, the applicable pricing, billing terms, renewal terms, and any plan-specific conditions will be disclosed to you at the time of purchase or activation and will become part of these Terms.

Unless otherwise expressly stated, fees are non-refundable to the fullest extent permitted by law. Promotional pricing, founding rates, trial offers, and feature availability may be modified, limited, or discontinued prospectively.

10. Intellectual Property Rights

The Services, including all software, code, interfaces, workflows, text, graphics, visual design, trademarks, logos, branding, product names, and other content or technology provided by StreetGauge, are owned by or licensed to StreetGauge and are protected by intellectual property and other applicable laws.

Except for the limited rights expressly granted in these Terms, no license or right is granted to you by implication, estoppel, or otherwise.

11. Feedback

If you provide suggestions, comments, ideas, feature requests, bug reports, or other feedback relating to the Services ("Feedback"), you grant StreetGauge a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free right to use, reproduce, modify, adapt, publish, distribute, and otherwise exploit that Feedback for any lawful purpose without restriction or compensation to you.

12. No Professional Advice; No Reliance

The Services are provided for informational and analytical purposes only. This tool provides estimates and does not constitute financial advice. StreetGauge does not provide financial, investment, securities, lending, accounting, legal, tax, appraisal, brokerage, or other professional advice. The Services do not recommend that you buy, sell, finance, lease, or hold any property or asset.

Any calculations, assumptions, forecasts, opportunity scores, narratives, comparisons, scenario outputs, market context, or other content generated or displayed by the Services are estimates, summaries, or decision-support tools only. They may rely on user inputs, third-party data, generalized assumptions, incomplete source data, or model logic that may contain errors or become outdated.

You are solely responsible for verifying all information, conducting your own due diligence, and making your own decisions. You should consult qualified professionals before making any financial, legal, tax, lending, acquisition, or real estate investment decision.

13. Disclaimers of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. STREETGAUGE DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, RELIABILITY, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPLETE, OR FREE OF HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, STREETGAUGE MAKES NO REPRESENTATION OR WARRANTY REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, LEGALITY, OWNERSHIP, QUALITY, OR USABILITY OF ANY THIRD-PARTY DATA, LISTING INFORMATION, PROPERTY INFORMATION, RENT ESTIMATES, COMPARABLES, OR OTHER EXTERNAL CONTENT USED WITH OR DISPLAYED THROUGH THE SERVICES.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STREETGAUGE AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, BUSINESS, OPPORTUNITIES, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF STREETGAUGE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO STREETGAUGE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50.00).

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the foregoing provisions may not apply to you to the extent prohibited by law. In those jurisdictions, StreetGauge's liability will be limited to the fullest extent permitted by applicable law.

15. Indemnification

You agree to defend, indemnify, and hold harmless StreetGauge and its affiliates, licensors, service providers, and personnel from and against any claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your access to or use of the Services;
  • your User Data;
  • your violation of these Terms;
  • your violation of applicable law or third-party rights; or
  • your misuse of third-party content, websites, or data in connection with the Services.

16. Suspension and Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if we reasonably determine that:

  • you have breached these Terms;
  • your use of the Services poses a security risk or legal risk;
  • your use may harm the Services, other users, or third parties; or
  • we are required to do so by law, legal process, or a provider relationship.

You may stop using the Services at any time. Provisions that by their nature should survive termination will survive, including provisions relating to ownership, Feedback, disclaimers, limitations of liability, indemnification, dispute-related provisions, and any payment obligations accrued before termination.

17. Exported Data and Local Copies

The Services may allow you to export or locally store data. Once data has been exported or stored outside the hosted Services, you are solely responsible for how that data is retained, secured, shared, or deleted. StreetGauge is not responsible for copies of data that remain on your devices, in your browser, in your extension storage, or in files you have downloaded or distributed.

18. Privacy

Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, store, and disclose information. If there is a conflict between these Terms and the Privacy Policy with respect to legal rights and obligations governing use of the Services, these Terms will control except to the extent applicable law requires otherwise.

19. Changes to the Services or These Terms

We may update these Terms from time to time. If we make material changes, we may update the effective date above and provide notice by posting the revised Terms through the Services, by email, or through another reasonable method. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the revised Terms.

20. Governing Law

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be governed by applicable laws of the United States, without regard to conflict of laws principles, except to the extent such principles are required to apply the law of another jurisdiction.

21. Miscellaneous

These Terms constitute the entire agreement between you and StreetGauge with respect to the Services and supersede prior or contemporaneous understandings on that subject. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms will not operate as a waiver of that provision or any other provision. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
